This document is an electronic record under the Information Technology Act, 2000, and is formulated in compliance with the Indian Contract Act, 1872; the Consumer Protection (E-Commerce) Rules, 2020; the IT (Intermediary Guidelines) Rules, 2021; and the Digital Personal Data Protection Act, 2023. This record is generated by a computer system and does not require physical or digital signatures.

Welcome to Aura Spectacles ("Company", "We", "Us"). By accessing our website, creating an account, or making a purchase, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms and our incorporated policies, including our Privacy Policy, Shipping Policy, and Refund & Exchange Policy.

1. DEFINITIONS

  • "Adaptation Period": The 2-7 day period required for a user's eyes and brain to adjust to new corrective lenses.
  • "Licensed Professional": A certified ophthalmologist or optometrist legally practicing in India.
  • "Prescription": A valid, unexpired order for corrective lenses issued within the last 12 months.
  • "PD (Pupillary Distance)": The measurement between pupil centers in millimeters, essential for accurate lens alignment.

2. ELIGIBILITY TO CONTRACT

You represent that you are at least 18 years of age and "competent to contract" as per the Indian Contract Act, 1872. Minors may only use this site under the direct supervision of a parent or legal guardian who agrees to be bound by these terms.

3. PRESCRIPTION ACCURACY & RESPONSIBILITY

Accuracy: You are 100% responsible for the accuracy of the prescription values you enter. Any visual discomfort or errors arising from incorrect data entry by the user are not the responsibility of Aura Spectacles.

Verification: We reserve the right to verify prescriptions with your Licensed Professional or request a photo of the original prescription before processing. We will only fulfill orders based on the exact details provided.

4. USER ACCOUNT & SECURITY

You are responsible for maintaining the confidentiality of your password and account. Aura Spectacles reserves the right to suspend or terminate accounts that show signs of fraudulent activity, breach of these terms, or bulk buying for unauthorized resale.

5. ACCEPTABLE USE POLICY

You agree not to engage in data scraping, crawling, or use of any automated bots/scripts to extract data. You shall not upload content that is unlawful, obscene, defamatory, or hateful. Interference with the security or functionality of the Website will result in immediate termination and legal action.

6. PRODUCT INFORMATION & PRICING

Invitation to Offer: Product displays are "invitations to offer." A contract is formed only when your order is dispatched. In the event of a technical pricing error, we reserve the right to cancel the order and provide a full refund.

7. ORDER CANCELLATION RIGHTS

Custom Nature: Spectacle lenses are bespoke products, custom-ground for your specific frame and power. Cancellation is only permitted within 2 hours of order placement. Once the laboratory commences the cutting/glazing process, the order becomes non-cancellable.

8. RETURN, EXCHANGE & REFUND POLICY

Frames: We offer a 7-day window for returns/exchanges if the frame is in its original, unused condition with all tags and packaging intact.

Lenses: As custom-made medical products, lenses are strictly non-refundable. A replacement will only be considered for verified manufacturing defects or dispensing errors (where the lens power does not match the prescription you provided).

Self-Ship: If reverse pickup is unavailable, the customer must self-ship the product to our Hyderabad studio. We will reimburse shipping costs up to ₹100 upon verification of a valid return.

9. SHIPPING & RETURN TO ORIGIN (RTO)

We are not liable for delays caused by courier partners or "Force Majeure" events. If a shipment is returned to us (RTO) due to an incorrect address or the user's repeated unavailability, a re-shipping fee will be charged for any subsequent delivery attempt.

10. INTELLECTUAL PROPERTY

All content on this website—including photography, logos, graphics, and code—is the exclusive property of Aura Spectacles. Unauthorized reproduction or commercial use is strictly prohibited and will result in legal action.

11. MEDICAL DISCLAIMER & ADAPTATION

Aura Spectacles is a fulfillment provider, not a medical consultant. We do not provide medical advice or diagnoses. New spectacles require an Adaptation Period of 2-7 days; temporary disorientation or mild headaches during this time are normal and are not considered a product defect.

12. LIMITATION OF LIABILITY & INDEMNITY

Liability: To the maximum extent permitted by law, our total liability to you for any claim shall not exceed the amount paid by you for that specific Product.

Indemnity: You agree to indemnify and hold harmless Aura Spectacles from any and all claims, damages, or legal expenses arising from your violation of these Terms or the submission of an inaccurate Prescription.

13. COMMUNICATION POLICY & REVIEWS

NDNC Waiver: By providing your contact details, you authorize us to contact you via Phone, SMS, or WhatsApp regarding your order status. This consent overrides any registration on the National Do Not Call (DND) registry for transactional purposes.

Reviews: By submitting a review, you grant Aura Spectacles a royalty-free right to use, reproduce, and moderate that content for marketing purposes.

14. GRIEVANCE REDRESSAL MECHANISM

In accordance with the Information Technology Act, 2000, and the Consumer Protection Rules, 2020:

We will acknowledge complaints within 48 hours and resolve them within 15 working days.

15. GOVERNING LAW & SEVERABILITY

Jurisdiction: These Terms shall be governed by the laws of the Republic of India. All disputes are subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana.

Severability: If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
